  • (ii) When you are our Customer and have signed up to and are using our platform ("Platform");
  • (iii) When you are a user viewing, accessing, interacting with, or otherwise using content shared via the Platform on a customer's website or e-commerce platform;
  • (iv) When you are a user browsing a customer's website and register with us;
  • (v) When you contact us (e.g., customer support, help requests, form submissions);
  • (vi) When you attend a marketing event or provide us with personal data for marketing purposes;
  • (vii) When we process the personal data of our service providers (e.g., contact details);
  • (viii) When we process the personal data of our customers (e.g., billing and account details); and
  • (ix) When you interact with us on social media platforms (e.g., Facebook, Instagram, Twitter/X, LinkedIn).

We greatly respect your privacy and make every effort to provide a platform that meets the highest user privacy standards. Please read this Privacy Policy carefully. "Personal Data" or "Personal Information" means any information that can be used, alone or in combination with other data, to uniquely identify a living human being.

Important: Nothing in this Privacy Policy is intended to limit any of your statutory rights, including your rights to a remedy or means of enforcement.

1. What Information We Collect, Why We Collect It, and How It Is Used

When you browse or visit our Website or Platform, we collect data about you through cookies, analytic tools, log files, and other tracking technologies. We collect this data to analyze trends, administer and improve the Website and Platform, and track movement around the Website and Platform. We use anonymous identifiers to present customized information and track user interactions.

When you are our Customer and use our Platform, you provide sign-up information including email address, full name, phone number, and payment information. While using the Platform, you may provide additional information such as videos, images, and other content uploaded to the Platform. We also collect your Platform usage data including analytics and IP address. We collect this information to:

  • Allow you to access and use the Platform and its services, including displaying videos on your e-commerce store;
  • Create and manage your account;
  • Communicate with you about your use of our services, including support and technical notices;
  • Fulfill requests made by you in the context of the Platform;
  • Send push notifications and emails regarding your account, subscription updates, and services;
  • Personalize your experience with our services;
  • Allow multi-user administration;
  • Generally administer and improve the services and the Platform; and
  • Send marketing communications using your name and email address (subject to your consent where required by law).

When you are a user viewing or interacting with content created via our Platform, we may collect email addresses, names, phone numbers, comments, IP addresses, time spent interacting with content, click data, and other information you or the relevant customer choose to share. We collect this information to allow you to view, access, interact with, and use the content created via our Platform.

When you register via a customer's website, we collect your email address and preferences (e.g., saved videos). We use this to manage your registration, send registration-related emails, save preferences, and provide relevant content. In this case, we will share your information with the relevant customer.

When you contact us (e.g., customer support), you provide your name, email address, country, and any messages or other information you choose to share. We use this information to answer your questions, provide support, and send marketing communications (subject to consent where required).

When you attend a marketing event or provide your data for marketing purposes, we collect your name, email address, phone number, company name, job title, country, and any other information you choose to share. We use this to establish a business connection and send marketing communications.

When we process the personal data of our service providers or customers, we collect name, email address, phone number, company name, job title, country, payment information, and other data provided. We use this to communicate with you, provide and improve services, perform contractual obligations, process payments, provide technical support, enforce our terms, prevent misuse, and take action in legal disputes.

When you interact with us on social media, we collect your name, email address, phone number, company name, job title, country, and any other data you choose to share, in order to communicate and respond to your requests.

Some of the above Personal Data may also be used for fraud detection and prevention, security purposes, auditing, complying with applicable laws, and responding to requests from law enforcement or regulatory authorities.

We may anonymize or de-identify Personal Data where appropriate. Anonymous Information does not enable identification of an individual and may be used and shared without restriction.

Legal bases for processing (where applicable):

  • (a) The data subject has given consent;
  • (b) Processing is necessary for the performance of a contract or pre-contractual steps;
  • (c) Processing is necessary for compliance with a legal obligation; and/or
  • (d) Processing is necessary for the purposes of our legitimate interests.

2. Google API Services and Limited Use Disclosure

VideoPoint's use and transfer to any other app of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements.

What Google User Data We Access

When you choose to connect your Google account to our Platform (for example, to sign in via Google or to integrate Google-based services), we may request access to the following Google user data:

  • Basic profile information (name, email address, profile picture) — used for account creation and authentication;
  • YouTube account data (read access via youtube.readonly) — used to view your YouTube channel and video information within the Platform;
  • YouTube video management (via youtube.upload) — used to upload videos from the Platform directly to your YouTube channel on your behalf.

How We Use Google User Data

We use Google user data solely to:

  • Authenticate and identify you when you sign in using Google;
  • Provide and improve the user-facing features of the Platform as directly requested by you;
  • Enable you to upload videos created or managed within the Platform directly to your YouTube channel;
  • Display information about your existing YouTube videos within the Platform interface to assist with content management.

Restrictions on Use of Google User Data

Consistent with Google's Limited Use requirements, we confirm that VideoPoint does not:

  • Use Google user data to serve advertisements, including personalized, retargeted, or interest-based advertising;
  • Transfer or sell Google user data to third parties, including advertising platforms, data brokers, or information resellers;
  • Use Google user data to determine credit-worthiness or for lending purposes;
  • Use Google user data to train generalized or non-personalized AI or machine learning models;
  • Allow any employee, contractor, or agent to read Google user data, except:
    • Where you have given explicit consent to view specific messages, files, or other data (e.g., for customer support);
    • Where necessary for security purposes (e.g., investigating abuse);
    • Where the data is aggregated and anonymized and used only for internal operational reporting in compliance with applicable law.

Storage of Google User Data

Google user data accessed via APIs is stored on our secure servers hosted by DigitalOcean in Germany. We retain this data only for as long as necessary to provide the services you have requested, or as required by applicable law. You may revoke VideoPoint's access to your Google account at any time via your Google Account permissions page.

In-Product Privacy Notice

When you connect your Google account or authorize access to Google services within our Platform, we display a prominent notice within the app interface describing what data is being accessed and how it will be used. You must actively grant permission before any Google account data is accessed.

3. How We Protect and Retain Your Information

3.1 Security

We have implemented appropriate technical, organizational, and security measures designed to protect your Personal Data. However, no system can guarantee absolute security. We cannot guarantee that information will not be compromised as a result of unauthorized penetration of our servers. Please ensure you use appropriate measures to protect your user credentials.

3.2 Retention of Your Personal Data

Your Personal Data will be stored until we proactively delete it or you submit a valid deletion request. In some circumstances we may store your Personal Data for longer periods, for example: (i) where required by law, regulation, tax, or accounting obligations; (ii) to maintain an accurate record of your dealings with us in the event of any complaints or challenges; or (iii) if we reasonably believe there is a prospect of litigation.

4. How We Share Your Personal Data

We share your Personal Data as follows:

4.1 Service providers and business partners: Including, without limitation, DigitalOcean (hosting), Pipedrive (CRM), Intercom (customer support), Sentry (monitoring and alerting), LogRocket (performance monitoring), Stripe (payment processing), Google Analytics (analytics), Amplitude (analytics), Mixpanel (analytics), Metabase (analytics), and Segment (analytics), to help us provide the Website and Platform services.

4.2 Customer integrations: Within the Platform, customers may connect third-party integrations and choose to share certain content or data with them. Such actions are taken by the customer at their own discretion and are subject to the customer's instructions.

4.3 Staff and group entities: With our employees and other entities within our corporate group, where necessary for business operations.

We may also share your Personal Data:

4.4 Legal compliance: To the extent necessary, with regulators, courts, or competent authorities to comply with applicable laws, regulations, and rules, and requests from law enforcement or governmental agencies.

4.5 Business transfers: If we sell or transfer, or consider selling or transferring, some or all of our business, shares, or assets, we may disclose your Personal Data to the relevant third party (whether actual or potential).

4.6 Corporate events: In the event we are acquired by or merged with a third party, or in the event of bankruptcy or a comparable event, we reserve the right to transfer, disclose, or assign your Personal Data.

4.7 With your consent: Where you have consented to us sharing or transferring your Personal Data (e.g., marketing opt-ins or optional additional services).

Note on Google user data: We do not transfer or disclose Google user data to any of the third parties listed above except where strictly necessary to provide the specific service you requested, and only in compliance with Google's Limited Use requirements. Google user data is never shared with analytics providers, advertising platforms, or data brokers.

5. Storage of Personal Data

5.1 Storage and access

We store your information on DigitalOcean servers located in Germany and may access your information from our office in Lithuania.

5.2 International transfers

To run our business and provide our Platform, we may transfer Personal Data to certain countries, including to our affiliates and service providers located outside your jurisdiction. Whenever we make such transfers, we use commercially reasonable efforts to ensure an appropriate level of protection by:

  • (i) Transferring to countries deemed to provide an adequate level of protection; and/or
  • (ii) Implementing appropriate data transfer instruments such as Standard Contractual Clauses or data processing agreements.

6. Your Privacy Rights

6.1 Rights

Subject to applicable law, you may have the following rights regarding your Personal Data:

  • Right of access: You have the right to obtain a copy of the Personal Data we hold about you. This is normally free of charge, though we reserve the right to charge an appropriate administrative fee where permitted by law.
  • Right to rectification: You have the right to request that we correct inaccurate or misleading Personal Data.
  • Right to erasure: You have the right to request deletion of your Personal Data from our records. Note that there may be circumstances where we are required to retain your data (e.g., for legal claims).
  • Right to data portability: Where processing is based on your consent or on a contract, and is carried out by automated means, you have the right to receive your Personal Data in a structured, commonly used, machine-readable format, and to have it transmitted to another controller where technically feasible.
  • Right to object: You have the right to object to processing of your Personal Data where we rely on legitimate interests as the legal basis, including for direct marketing purposes.
  • Right to restrict processing: You have the right to request that we restrict the processing of your Personal Data in certain circumstances (e.g., while we verify the accuracy of your data).
  • Right to withdraw consent: Where processing is based on consent, you may withdraw that consent at any time, without affecting the lawfulness of processing before withdrawal.
  • Right to lodge a complaint: You have the right to lodge a complaint with a data protection supervisory authority in your country of residence, place of work, or place of the alleged infringement. In Lithuania, this is the State Data Protection Inspectorate (vdai.lrv.lt).

6.2 Exercising your rights

To exercise any of the above rights, contact us at data@videopoint.ai. We will respond promptly in accordance with applicable law. We may ask you to verify your identity before processing your request. We reserve the right to charge a fee where permitted by law.

6.3 Deleting your account

To delete your account, email data@videopoint.ai. Upon account deletion, your Personal Data will no longer be accessible through your account. However, any content that was publicly shared prior to deletion may remain stored on our servers and accessible to the public.

6.4 Marketing opt-out

To stop receiving marketing emails, send an email with the subject "BLOCK" from the account you wish to unsubscribe to data@videopoint.ai, or use the unsubscribe link in any marketing email we send. We will process your request within a reasonable time.

7. California Privacy Rights (CCPA)

If you are a California resident, you may have additional rights under the California Consumer Privacy Act (CCPA) and, where applicable, the California Privacy Rights Act (CPRA):

  • Right to know: You have the right to request that we disclose the categories and specific pieces of Personal Information we have collected about you, the categories of sources, the business or commercial purposes for collecting it, and the categories of third parties with whom we share it.
  • Right to delete: You have the right to request deletion of Personal Information we have collected from you, subject to certain exceptions.
  • Right to correct: You have the right to request correction of inaccurate Personal Information.
  • Right to opt out of sale or sharing: We do not sell or share your Personal Information with third parties for cross-context behavioral advertising. If this practice changes, we will update this policy and provide an opt-out mechanism.
  • Right to non-discrimination: We will not discriminate against you for exercising any of your CCPA rights.

8. Use by Children

We do not offer our products or services for use by children under the age of 18. We do not knowingly collect Personal Data from children under 18. If you are under 18, do not provide any Personal Data to us without the involvement of a parent or guardian. If we become aware that we have collected Personal Data from a child in violation of applicable law, we reserve the right to delete it. 9. Interaction with Third-Party Products

Our Platform enables you to interact with third-party websites, mobile applications, and products or services that are not owned or controlled by us ("Third Party Services"). We are not responsible for the privacy practices or content of such Third Party Services. Third Party Services may collect Personal Data from you independently. We encourage you to review the terms and conditions and privacy policies of each Third Party Service you use.

10. Log Files

We use log files to analyze trends, administer the Website and Platform, track user movement, and gather demographic information. Log data is used for operational and security purposes.

11. Analytic Tools

11.1 Google Analytics

Our Website and Platform use Google Analytics to collect information about usage, including how often users visit, which pages they visit, and what sites they used prior to visiting. We use this data to maintain and improve the Website, Platform, and our products. We do not combine Google Analytics data with Personal Data we collect directly. Google's use of this data is governed by the Google Analytics Terms of Service and Google Privacy Policy. You can opt out using the Google Analytics Opt-out Browser Add-on.

11.2 Mixpanel

We use Mixpanel to collect Personal Information such as email address and user activity. Mixpanel's use of this information is governed by their Terms of Use and Privacy Policy. You can opt out at mixpanel.com/optout.

11.3 Segment

Some of the Personal Information we collect may be shared with Segment. Their access is governed by their Terms of Service.

We reserve the right to remove or add analytic tools. This policy will be updated accordingly.
